Conflicto de competencia suscitado entre el Juzgado Promiscuo Municipal de El Copey (Cesar) y el Juzgado Municipal de Pequeñas Causas Laborales de Santa Marta.
La controversia se originó en las diferentes interpretaciones del factor territorial.
Teniendo en cuenta que el accionante escogió dentro del factor territorial la “competencia a prevención”, considera la Corte que debe respetarse su elección.
Consecuentemente, determina que la autoridad competente para tramitar la acción de tutela formulada es la del municipio de El Copey.
Se ordena remitir el expediente a dicho juzgado para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Primero. DEJAR SIN EFECTOS el auto del 7 de noviembre de 2017 proferido por el Juzgado Promiscuo Municipal de El Copey, Cesar, mediante el cual se declaró sin competencia para conocer de la acción de tutela presentada por el señor Rober Alexander Guerra Sánchez contra la Secretaría de Tránsito y Transporte de Santa Marta.
- Segundo. REMITIR el expediente ICC-3237 al Juzgado Promiscuo Municipal de El Copey, Cesar, que contiene la acción de tutela presentada por el señor Rober Alexander Guerra Sánchez para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
- Tercero. Por la Secretaría General de la Corporación, COMUNICAR a la parte actora y al Juzgado Municipal de Pequeñas Causas Laborales del Distrito Judicial de Santa Marta, la decisión adoptada en esta providencia.
